Odessa, Texas --  The state of Texas has a relatively large number of smoke shops.  Selling everything to smoke accessories, novelties, and an assortment of THC-based products and consumables.  How are they able to do this?  Isn't THC illegal?  Well, technically, no.

In 2019, a Texas law (House Bill 1325) was passed allowing the selling of commercialized THC consumables under 0.3%.  So selling these kinds of products is perfectly legal.

Fast-forward to 2025. State Senator Charles Perry wrote Bill 3, which would outlaw the sale of non-medical THC products in all capacities. It's quick to note Lt. Governor Dan Patrick is reported to support this bill among other GOP lawmakers.  Mr. Perry concluded that the 2019 law creates a loophole for smoke shops in which it allows them to sell THC products such as Delta-8.  He further goes on to say that many of the products being commercially sold are well beyond the 0.3% legal limit.  If Bill 3 is passed by state legislation, it would eliminate the commercial sale of Delta 8 or any other products induced with THC, essentially making all smoke shops cease carrying and selling these products or face legal consequences which could include jailtime, citations, or even fines.

As of this moment, Senate Bill 3 is only in the beginning phases and has not yet been determined if it will get a full senate vote.  Supporters of this bill will attempt to justify that it will take illegal and harmful products off the street.  However, what supporters fail to realize is that this will hurt a lot of businesses.  Mainly mom and pop stores and smoke shops. 

What will become of this?  Only time will tell.
